Beware of Trademark Scams: Protect Your Business From Fraudulent Letters and Calls!

As an attorney, I’ve recently had several clients reach out and be concerned about suspicious letters and phone calls they’ve received regarding their trademarks. If you’re a business owner or entrepreneur who has filed a trademark with the United States Patent and Trademark Office (USPTO), you should be aware that these types of scams are on the rise. Down below are examples of what scam letters look like.

I even received a scam call myself regarding one of my client’s trademarks. The caller pretended to be an attorney and tried to create a sense of urgency about an issue with the trademark. When the “attorney” hung up on me I immediately called back. I was connected to a completely different person who also claimed to be an attorney with the same name as the previous call. This was a clear indication that something wasn’t right.

What Are Trademark Scams?

Trademark scams typically involve fraudulent calls or letters that appear official. These scammers often impersonate legal professionals or agencies, claiming that your trademark is at risk, or they may offer additional services that are unnecessary and overpriced. They normally ask for payment immediately or try to pressure you into acting fast.

How Do These Scams Work?

Once you file a trademark with the USPTO, the information becomes a public record. This includes your business name, trademark details, and contact information. Scammers use this public data to target unsuspecting business owners, hoping to convince them that they need to pay for services that are already covered under their trademark registration.

Scam Communications Can Take Many Forms, Such As:

  1. Official-looking letters stating that you owe money for trademark services or extensions that are not necessary.

  2. Phone calls from individuals posing as attorneys or legal experts, claiming your trademark is in jeopardy.

  3. Emails that appear to be from USPTO or a legal firm offering unsolicited services.

How to Protect Yourself:

Here are a few simple steps you can take to avoid falling for trademark scams:

  1. Do not respond to unsolicited communications: If you receive a letter, email, or call from a source you don’t recognize, don’t provide any personal information or make any payments.

  2. Double-check with your attorney: If you’re ever unsure about a communication, reach out to us directly. As your trusted attorney, we can verify whether something is legitimate or a scam.

  3. Trust the USPTO: All trademark-related information comes from official channels like the USPTO or your attorney not from a random third-party company. If you’re receiving letters or calls that don’t come from us or the USPTO, be suspicious.
